Service Terms (AGB)

These General Terms of Service (“Service Terms”) govern the provision of the GoFitDaddy service to you. They are separate from, and additional to, the Terms of Use for the application software (the app licence). Where the app licence covers your right to install and use the software, these Service Terms cover the online service delivered through it.
1. Provider and Scope
The service is provided by Martrick GmbH (“we”, “us”), operator of the GoFitDaddy app. These Service Terms apply to every user of the service, whether on a free or paid basis.

2. Description of the Service
GoFitDaddy is an 18+ LGBTQ+ community, fitness and dating service. Depending on your region and plan, the service may include:
- Profiles & discovery — creating a profile and browsing other members
- Messaging — 1:1 and group chat, taps, photo and album sharing
- Events & meetups — discovering, hosting and RSVPing to events
- Community & safety tools — tribes, stealth mode, trusted-contacts, travel safety information
- Informational content — LGBTQ+ city guides, clinic directories and wellness information
The precise features available may change over time and may differ by country and by subscription tier. A fuller functional description is set out in our user manual, which forms part of the description of services.
3. Conclusion of Contract
A contract for the use of the service is concluded when you create an account and it is activated. For paid features, a separate contract is concluded when you complete the purchase.
4. Free and Paid Services; Prices
The core service is available free of charge. Optional paid features (e.g. the GoFitDaddy+ subscription and event tickets) are offered at the prices shown at the point of purchase, inclusive of applicable taxes. Subscriptions renew automatically for the selected period unless cancelled before the end of the current period.
- In-app purchases and subscriptions are processed by the Apple App Store or Google Play and are also subject to their terms.
- Event tickets may be processed by an external payment provider.
5. Right of Withdrawal (Consumers)
If you are a consumer in the EU/EEA, you have a statutory right to withdraw from a contract for paid digital services within 14 days without giving reasons. Where you expressly request that we begin providing a paid digital service before the end of the withdrawal period and acknowledge that you thereby lose your right of withdrawal once the service has been fully performed, your right of withdrawal expires accordingly. Withdrawal for store-processed purchases is handled under the rules of the respective app store.
6. Availability and Changes
We aim to keep the service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features, in particular for security, legal or technical reasons, and will give reasonable notice of material changes where practicable.
7. Your Obligations
- Provide accurate information and keep your account secure.
- Use the service lawfully and respect other members (see the app Terms of Use).
- Not misuse, scrape or overload the service or its interfaces.
8. Informational Content — No Guarantee
Certain content is provided for information only — in particular health, wellness, clinic, harm-reduction and country/travel-safety information, and community-contributed city guides. Such content is not professional, medical, legal or travel advice, may be incomplete or out of date, and must be independently verified before you rely on it. We do not warrant its accuracy and, to the extent legally permissible, accept no liability for decisions taken on the basis of it.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law (including consumer-protection law) so provides. For slight negligence we are liable only for breach of a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible at all), and then limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.
9.1 Product safety and product liability
Statutory liability regimes remain unaffected, including obligations under the EU Cyber Resilience Act (product cybersecurity) and liability under the EU Product Liability Directive as implemented in national law.
10. Term and Termination
The free service runs for an indefinite period and may be terminated by you at any time by deleting your account. Paid subscriptions run for the selected term and may be cancelled with effect from the end of the current period. We may terminate or suspend access for cause, including material breach of these Service Terms or the app Terms of Use.
11. Changes to these Service Terms
We may amend these Service Terms where there is a valid reason (e.g. changes in law, features or the fee model). We will notify you of material changes and, where your consent is required, ask for it before the changes take effect.
12. Governing Law and Jurisdiction
These Service Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of habitual residence remain unaffected. Country-specific amendments may apply in individual target markets.
