Please read these Terms carefully. By creating an account or using GoFitDaddy, you agree to be bound by these Terms of Service. If you do not agree, do not use this App.

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Martrick GmbH (“GFD”, “Company”, “we”, “us”, “our”), operator of the GoFitDaddy app, governing your use of GoFitDaddy (the “App”). These Terms apply to all users worldwide.

By registering, accessing, or using the App, you confirm that:

• You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher)
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the App under applicable law
• You have read and agree to our Privacy Policy, Community Guidelines, and Cookie Policy

2. Eligibility and Age Verification

The App is strictly for adults aged 18 and over. By using the App, you represent and warrant that you meet this requirement.

• We reserve the right to request age verification documents at any time
• Accounts suspected of being underage will be suspended immediately pending verification
• Providing false information about your age is a serious violation and will result in permanent account termination
• We comply with applicable child protection laws worldwide and report violations to the appropriate authorities

3. Account Registration

To use most features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Keep your login credentials confidential and not share them with others
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to refuse registration or cancel accounts at our sole discretion.

4. Acceptable Use

4.1 Permitted Use

You may use the App only for lawful purposes and in accordance with these Terms. The App is for personal, non-commercial use only.

4.2 Prohibited Conduct

You agree NOT to:

• Use the App if you are under 18 years of age
• Post, upload, or share any content involving minors in any context
• Share, create, or distribute child sexual abuse material (CSAM) — this will result in immediate account termination and reporting to law enforcement
• Impersonate any person or entity or misrepresent your identity
• Harass, bully, threaten, stalk, or intimidate other users
• Post content that is defamatory, discriminatory, hateful, or incites violence
• Use the App for any commercial purpose, including solicitation, advertising, or escort services
• Share or sell controlled substances or illegal goods or services
• Distribute malware, viruses, or any code designed to harm systems
• Scrape, crawl, or extract data from the App without authorisation
• Circumvent any technical measures we use to enforce these Terms
• Use automated systems to access the App without our permission
• Violate any applicable local, national, or international law

4.3 Content Standards

All content you post must comply with our Community Guidelines. We reserve the right to remove any content that violates these Terms or that we find objectionable at our sole discretion.

5. User Content

5.1 Your Content

You retain ownership of content you submit to the App. By posting content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, modify, adapt, publish, and display that content for the purpose of operating and improving the App.

5.2 Content Moderation

We use automated systems and human reviewers to moderate content. We may remove content or suspend accounts without prior notice if we believe a violation has occurred. You may appeal moderation decisions through our in-app appeals process.

5.3 CSAM Policy

We have a zero-tolerance policy for child sexual abuse material. We use industry-standard tools including PhotoDNA to detect and report such content. All CSAM discoveries are immediately reported to:

• National Center for Missing and Exploited Children (NCMEC) — USA
• Bundeskriminalamt (BKA) — Germany
• Relevant national authorities in the user’s jurisdiction

6. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of GoFitDaddy and its licensors. Our trademarks and trade dress may not be used without our prior written permission.

You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code, unless permitted by law.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

8. Payments and Subscriptions

Some features of the App require payment. By purchasing a subscription or in-app purchase, you agree to:

• Pay all applicable fees as shown by the App Store or Google Play at the time of purchase
• Accept that Apple or Google, not GoFitDaddy, is the seller and merchant of record. They take the payment and hold your payment details; we never see or store your card data.
• Manage or cancel a subscription in your Apple or Google account settings. We cannot cancel it for you, and deleting the App does not cancel it.

Subscriptions automatically renew unless cancelled before the renewal date. Refund policies comply with applicable consumer protection laws in your jurisdiction. EU/EEA consumers have a 14-day right of withdrawal for digital services not yet commenced.

9. Disclaimers and Limitation of Liability

The App is provided “as is” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

To the maximum extent permitted by applicable law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from user-generated content or interactions between users
• Any matter beyond our reasonable control

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. Consumer rights under applicable law are not affected.

10. Indemnification

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from your use of the App, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason including violation of these Terms. Upon termination:

• Your right to use the App will immediately cease
• We may delete your account data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will remain in effect

You may terminate your account at any time through the App settings. EU/EEA users have the right to request data deletion upon termination.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles. EU consumer protection laws apply to users in the EU/EEA.

12.2 EU/EEA Users

If you are a consumer in the EU/EEA, you may also bring proceedings in the courts of your country of residence. The European Commission’s Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr

12.3 Other Jurisdictions

Users in other jurisdictions may have additional rights under local law. We respect mandatory consumer protection provisions in all jurisdictions where we operate.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or email at least 30 days before the changes take effect (or as required by applicable law). Continued use after the effective date constitutes acceptance of the updated Terms. EU/EEA consumers have the right to terminate the agreement if they do not accept material changes.

14. Miscellaneous

• Severability — if any provision is found invalid, the remaining provisions continue in effect
• Waiver — failure to enforce any right does not constitute a waiver
• Entire Agreement — these Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and us
• Assignment — we may assign our rights under these Terms; you may not without our consent
